1. Acceptance of Terms

By accessing, browsing, or otherwise using buddybuysit.com (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, you must immediately discontinue use of the Site. These Terms apply to all visitors, users, leads, and any other persons who access or use the Site, regardless of whether they complete a transaction with BBI Real Estate Holdings LLC.

Your continued use of the Site following the posting of any changes to these Terms constitutes your binding acceptance of those changes. We reserve the right to change, modify, add, or remove portions of these Terms at any time without prior notice. It is your responsibility to check these Terms periodically for updates.

2. About BBI Real Estate Holdings LLC

The Site is owned and operated by BBI Real Estate Holdings LLC (“BBI,” “we,” “us,” or “our”), a real estate investment company with a mailing address of P.O. Box 60, Vandergrift, PA 15690. BBI purchases residential real estate directly from homeowners on a cash basis.

BBI Real Estate Holdings LLC is not a licensed real estate broker or sales agent and does not provide real estate brokerage services. Nothing on this Site should be construed as an offer to act as a buyer’s or seller’s real estate agent. If you are seeking representation in a real estate transaction, please consult a licensed real estate professional. BBI has an affiliated relationship with BMRE, Inc. 3. Eligibility

The Site is intended for use by individuals who are at least 18 years of age and who have the legal authority to enter into binding contracts under applicable law. By using the Site, you represent and warrant that you meet these eligibility requirements. If you are using the Site on behalf of a company, organization, or other legal entity, you further represent that you have the authority to bind that entity to these Terms.

4. Permitted Use of the Site

You may access and use the Site solely for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates applicable federal, state, or local law or regulation;
• To transmit or procure the sending of any unsolicited or unauthorized advertising or promotional material;
• To impersonate or attempt to impersonate BBI, a BBI employee, another user, or any other person or entity;
• To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site;
• To attempt to gain unauthorized access to any part of the Site or any connected systems or networks;
• To introduce viruses, malware, or other malicious or technologically harmful material;
• To scrape, crawl, or otherwise harvest data from the Site without our express written consent;
• To use the Site to engage in any form of fraud, deception, or misrepresentation.

5. Submission of Information and Communications Consent

When you submit your name, phone number, property address, email address, or any other information through any form, widget, or other submission mechanism on the Site, you are providing that information voluntarily and consent to its use as described in these Terms and our Privacy Policy.

By submitting your information, you expressly consent to receive calls, text messages, and emails from BBI Real Estate Holdings LLC and its affiliates, partners, and service providers, including communications delivered via automated telephone dialing systems (ATDS), pre-recorded voice messages, artificial voice messages, and SMS/MMS messaging, at the telephone number(s) and email address(es) you provide. This consent applies even if your number is on a state or national Do Not Call registry. The frequency of messages may vary. Message and data rates may apply. You may opt out of text messages at any time by replying STOP. You may opt out of emails by clicking the unsubscribe link in any marketing email or contacting us at . Opting out of marketing communications does not affect our ability to contact you regarding a transaction or legal matter. Consent to receive marketing communications is not a condition of any purchase, sale, or other transaction with BBI.

6. No Real Estate Brokerage Services

BBI Real Estate Holdings LLC is a real estate investment company and cash home buyer. BBI is not a licensed real estate broker, sales associate, or agent. Nothing contained on this Site, in any written communication from BBI, or in any conversation with a BBI representative constitutes real estate brokerage services, legal advice, tax advice, or financial advice. BBI does not represent buyers or sellers in their capacity as a licensed agent or broker.

In states where BMRE, Inc. (Blake McNeely Real Estate) is licensed, BMRE, Inc. may act as a buyer’s agent on behalf of BBI in connection with the purchase of your property, or BMRE, Inc. may separately offer its services to you as a client. 7. No Warranties; Site Provided “As Is”

THE SITE AND ALL CONTENT, INFORMATION, MATERIALS, AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BBI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BBI DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE RESULTS OF USING THE SITE WILL MEET YOUR REQUIREMENTS. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITE IS ACCESSED AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BBI REAL ESTATE HOLDINGS LLC AND ITS MANAGERS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “BBI PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, INFORMATION, OR SERVICES OBTAINED THROUGH THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BBI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE BBI PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless BBI Real Estate Holdings LLC and the BBI Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right, privacy right, or property right; or (d) any claim that information you submitted to the Site is false, misleading, or inaccurate.

10. Intellectual Property

The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, photographs, audio, video, data compilations, software, and the selection and arrangement thereof — are owned by BBI Real Estate Holdings LLC, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site;
• Delete or alter any copyright, trademark, or other proprietary rights notices;
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text;
• Use any content from the Site for commercial purposes without our prior written consent.

The Site may contain links to or integrations with third-party websites, services, and applications that are not owned or controlled by BBI. BBI has no control over and assumes no responsibility for the content, privacy policies, terms of service, or practices of any third-party sites or services. We do not warrant the offerings of any of these entities or individuals or their websites. You acknowledge and agree that BBI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party website or service. Linking to any third-party website does not imply endorsement by BBI.

Your use of the Site is governed by our Privacy Policy and Cookie Policy, each of which is incorporated into these Terms by this reference. Please review those policies carefully. 13. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to the Site or these Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts of competent jurisdiction located in Westmoreland County, Pennsylvania, and you irrevocably consent to the personal jurisdiction and venue of such courts.

WAIVER OF CLASS ACTION: TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST BBI. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Entire Agreement; Severability

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and BBI with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

15. Changes to These Terms

We reserve the right to modify these Terms at any time and at our sole discretion. All changes are effective immediately when we post them.
